Terms and Conditions – ThinkZoe
Last updated: 12 October 2026
1. General provisions
These terms and conditions govern the use of www.thinkzoe.com and the purchase and delivery of services under the ThinkZoe brand. The service provider is:
- JAK, Jaka Oman s.p., Srednje Bitnje 55, 4209 Žabnica, Slovenia
- Company registration number: 6771807000
- VAT ID: SI34006907
- Email: jaka@thinkzoe.com, phone: +386 31 346 939
By paying, confirming an order or quote, or using free resources, the client confirms that they have read and agree to these terms. Specific terms set out in a quote or contract may also apply to a particular service; these take precedence over these general terms.
A consumer is a natural person who buys a service for purposes outside their trade, business or profession. A business client is a company or sole trader who buys a service for their business. Provisions that protect consumers apply only to consumers.
2. Services
ThinkZoe Flow Program – an online flow development program that includes pre-recorded video lessons, workbooks, Flow Index measurement, personal 1:1 sessions, group sessions and access to the community, as described on the program sales page at the time of purchase.
1:1 sessions (coaching and mentoring) – individual sessions or session packages via Google Meet, WhatsApp or in person.
Corporate workshops – workshops, talks and programs for teams and organisations, including with the LEGO® SERIOUS PLAY® method, delivered in person or online based on a quote.
Free resources – Flow Test, Potential Test, worksheets, e-books and the newsletter.
3. Ordering and conclusion of contract
- Program and 1:1 sessions: the contract is concluded when the client pays on the website or pays the pro forma invoice received after a call. The client receives a purchase confirmation by email.
- Corporate workshops: the contract is concluded when the client confirms the quote or order in any written form: by email, by purchase order or by signing a contract. If a separate contract is signed, its provisions take precedence over these terms; where confirmation is by email or purchase order, the quote and these terms apply. A quote is valid for [30 days] unless stated otherwise.
- The provider may decline to conclude a contract if, in their professional judgement, the program is not a good fit for the client (for example after an introductory call). Any amount already paid is then refunded in full.
4. Prices and payment
- Prices are in euros and are final. The provider is not a VAT payer (exempt from charging VAT under Article 94(1) of the Slovenian VAT Act, ZDDV-1), so prices do not include VAT and no VAT is shown on invoices.
- The provider holds a VAT ID only for cross-border services (Article 78 ZDDV-1). For services to business clients established in another EU member state, VAT is accounted for and paid by the recipient (reverse charge).
- Payment is possible by card via Stripe (once introduced) or by bank transfer against a pro forma invoice or invoice.
- If payment in instalments is agreed, instalments must be paid on time. In case of late payment, the provider may temporarily suspend access to the program or sessions until the overdue amount is paid.
- Business clients pay invoices within [15 days] of issue. Statutory default interest is charged on late payments.
- Invoices are issued electronically.
5. ThinkZoe Flow Program
- Access to video lessons and materials lasts [12 months] from the program start, unless stated otherwise at purchase.
- Access is personal and non-transferable. Login details, videos and materials may not be shared with others.
- 1:1 sessions included in the program must be used during the program and no later than [3 months] after it ends. Unused sessions then expire without refund.
- The provider may improve and update program content, provided the program's essential features are not diminished.
- The client is responsible for having a suitable device and internet connection.
6. 1:1 sessions
- Sessions are booked via Calendly or by arrangement, and take place via Google Meet, WhatsApp or in person.
- A session can be cancelled or rescheduled free of charge at least [24 hours] before it starts. Later cancellation or no-show counts as a completed session.
- If the client is late, the session still ends at the originally scheduled time. A delay of more than [15 minutes] without notice counts as a completed session.
- If the provider cancels a session, a new time is arranged at no cost to the client.
- Sessions are not recorded without the explicit consent of both parties.
7. Right of withdrawal (consumers only)
A consumer may withdraw from a contract concluded at a distance (e.g. via the website, email or phone) within 14 days of concluding the contract, without giving any reason. Withdrawal is made by a clear statement sent to jaka@thinkzoe.com or using the form attached to these terms. The deadline is met if the statement is sent before it expires.
The provider will refund all payments received no later than 14 days after receiving the withdrawal statement, using the same payment method as the original payment, unless expressly agreed otherwise.
Exceptions and limitations:
- Digital content (program video lessons and materials): we grant immediate access after purchase only if the consumer expressly consents to performance starting before the withdrawal period ends and acknowledges that they thereby lose their right of withdrawal. With such consent, the right of withdrawal for digital content ends. If the consumer does not give this consent, access is granted after the 14-day period.
- Services (1:1 sessions, group sessions): if the consumer expressly requests that the service starts during the withdrawal period and then withdraws, they pay a proportionate amount for services provided up to withdrawal. Once the service has been fully performed, and the consumer has previously acknowledged this, the right of withdrawal ends.
- For a program that includes both digital content and services, both rules above apply separately.
8. Corporate workshops
- Content, duration, location, number of participants, price and any travel costs are set out in the quote (or in the purchase order or contract).
- The provider issues the invoice after the workshop is delivered, unless agreed otherwise in the quote, purchase order or contract. The client pays it within the period set out in section 4.
- The client provides a suitable room and technical equipment as agreed in the quote. Workshop materials (including LEGO® sets) are provided by the provider and remain the provider's property unless agreed otherwise.
- Travel, accommodation and daily allowances are charged as set out in the quote.
- The date may be rescheduled once free of charge if the client gives at least [14 days'] notice and the new date is within [6 months].
- If the provider cannot deliver due to illness or force majeure, the workshop is rescheduled. If no new date can be agreed, all payments for the undelivered part are refunded.
- Photography and recording of the workshop are allowed only by agreement and with participants' consent.
Cancellation of a workshop by the client:
The client may cancel a workshop in writing (email is sufficient) at any time before it starts. In that case the client pays:
- material costs already incurred up to cancellation that cannot be refunded or otherwise used (e.g. specially purchased or produced materials, printed materials, tickets, accommodation, room or equipment rental),
- preparation work carried out up to cancellation (e.g. briefing calls, adapting content, preparing the workshop design, materials and questions), charged at the hourly rate stated in the quote or [EUR X per hour].
On request, the provider will provide a breakdown of costs and hours worked. If the client reschedules in line with the point above, no cancellation costs are charged.
9. Intellectual property
All videos, texts, workbooks, tools, models, presentations, logos and other ThinkZoe content are the provider's copyrighted work. Clients may use them only for personal use or for the internal needs of their organisation. Copying, recording, sharing, reselling, publishing or using them to run one's own workshops or programs is not permitted without the provider's prior written consent.
LEGO® and SERIOUS PLAY® are trademarks of the LEGO Group, which does not sponsor, authorise or endorse this service.
10. Community and confidentiality
- Members of the program community (WhatsApp group and group sessions) treat each other with respect. Offensive behaviour, harassment, advertising and unsolicited selling are not allowed.
- What participants share in sessions and in the community is confidential and is not shared outside the group.
- The provider may remove a participant from the community for breaching these rules, and in serious cases from the program, without refund.
- The provider keeps confidential everything clients share in 1:1 sessions and workshops.
11. Nature of services and limitation of liability
- ThinkZoe services are educational and coaching in nature. They are not medical, psychological or psychotherapeutic treatment and do not replace it. Clients experiencing burnout, serious distress or health problems should consult a doctor or other qualified professional.
- Results depend on each client's engagement and circumstances, so the provider does not guarantee specific results.
- Clients decide for themselves whether to apply recommendations (including exercise, breathing techniques, cold exposure and similar) and do so at their own responsibility.
- The provider's liability for damages is limited to the amount the client paid for the service concerned, except for damage caused intentionally or through gross negligence. This limitation does not affect consumers' statutory rights.
- The provider is not liable for temporary unavailability of the website or of third-party services (Google Meet, WhatsApp, Calendly, Stripe and similar).
12. Force majeure
Neither party is liable for failure to perform due to circumstances beyond its control (e.g. natural disasters, epidemics, power or network outages, illness of the facilitator). In such cases, the service is delivered on a new agreed date or online.
13. Personal data
Processing of personal data is described in the Privacy Policy and Cookie Policy at www.thinkzoe.com.
14. Complaints and disputes
- Complaints can be sent to jaka@thinkzoe.com. The provider confirms receipt within 5 working days, states how long handling will take, and keeps the client informed.
- The provider aims to resolve every dispute amicably.
- The provider does not recognise any out-of-court consumer dispute resolution body as competent.
- These terms are governed by the law of the Republic of Slovenia. This does not deprive consumers of the protection of mandatory laws of their country of residence.
- Disputes with business clients fall under the jurisdiction of the competent court in Kranj, Slovenia.
15. Changes to these terms
The provider may amend these terms. The current version is published on the website with its last-updated date. Contracts already concluded remain subject to the terms in force at the time of conclusion.
